1. Acceptance of Terms & Scope of Agreement
These Terms of Service ("Terms," "Agreement") govern your access to and use of DViBe ("DViBe," "Service," "we," "our," or "us"), operated at dvibe.dev and associated subdomains.
By booking an onboarding consultation, connecting our GitHub or Slack applications, or accessing the DViBe Situation Room dashboard, you agree to be bound by these Terms. If you are entering into this Agreement on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.
2. Description of the DViBe Platform
DViBe is an Autonomous Engineering Management intelligence layer designed to assist technical founders and engineering managers. The service includes:
- Automated telemetry ingestion and status correlation across connected GitHub pull requests, commit timestamps, and CI/CD assertions.
- Daily 9:00 AM Situation Capsules highlighting stalled reviews, schema changes, and launch blocker risks.
- 1-Click Slack Decision Dispatch interfaces to unblock developers without scheduling status meetings.
- An interactive Situation Room web dashboard displaying team velocity, blocker duration, and release readiness scores.
3. Private Beta Program & Free Onboarding
DViBe is currently available under an exclusive Private Beta program. During this period:

Qualified engineering teams invited to the Private Beta receive complimentary access to all Core and Velocity tier capabilities with unlimited team seats and zero credit card required.
Beta services are provided on an "AS IS" and "AS AVAILABLE" basis for evaluation and feedback purposes. We continuously update and refine heuristics, features, and UI interfaces to optimize engineering clarity.
4. Customer Content & Intellectual Property Ownership
You retain 100% full, unencumbered ownership of your code:
- Customer Ownership: All source code, commit histories, pull request diffs, code review commentary, Slack messages, and architectural files analyzed by DViBe remain the sole property of Customer ("Customer Content"). DViBe claims zero ownership, license, or right to Customer Content beyond the narrow, transient permission required to execute ephemeral analysis.
- Zero-Train Guarantee: DViBe will not train, fine-tune, or calibrate public AI foundational models (such as GPT-4, Claude, or Gemini) using Customer Content. All processing is transient and stateless.
- DViBe Platform IP: DViBe retains all right, title, and interest in and to the platform, algorithmic scoring heuristics, UI software, documentation, and logos.
5. Third-Party Integrations (GitHub & Slack)
To utilize DViBe, you must connect our application to your organization's GitHub organization and Slack workspace:
- You represent that you have acquired all necessary authorizations and administrative permissions from your organization to connect these services.
- DViBe operates strictly within the granular OAuth scopes requested and complies with GitHub's API Terms of Service and Slack's Developer Guidelines.
- You may revoke GitHub App access or remove the Slack App at any time from your organization's administrative settings.
6. Acceptable Use & Customer Obligations
When using DViBe, you agree not to:
- Attempt to reverse engineer, decompile, or extract source algorithms of the DViBe engine or Situation Room dashboard.
- Bypass or attempt to circumvent tenant isolation, Row-Level Security policies, or authentication mechanisms.
- Transmit malicious code, viruses, or automated scrapers designed to overload our edge infrastructure.
- Use DViBe to build a competitive automated engineering management or AI CTO product.
7. Disclaimers & Engineering Responsibility
DViBe provides automated diagnostics, launch readiness estimations, and blocker notifications based on signals emitted by developer tools.
Customer Retains Final Engineering Decision Authority:
DViBe is a decision support tool, not an autonomous deployment agent. All production deployments, code merges, architectural migrations, and software release approvals remain the sole discretion and responsibility of your human engineering team.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DVIBE PROVIDES THE SERVICE "AS IS" AND DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. Limitation of Liability
IN NO EVENT SHALL DVIBE, ITS FOUNDERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR SYSTEM DOWNTIME) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
DVIBE'S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY CUSTOMER TO DVIBE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD (WHICHEVER IS GREATER).
9. Termination & Data Deletion
Either party may terminate this Agreement at any time:
- Customer may terminate by uninstalling the GitHub App and notifying support at
support@dvibe.dev. - Upon receipt of a termination request, DViBe will permanently purge all workspace metadata, historical blocker records, and team summaries within thirty (30) days in accordance with our Privacy Policy.
10. Governing Law & Legal Notices
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of incorporation, without regard to conflict of law principles.
